Terms of service

These Terms of Service govern your access to and use of thethirdfacet.com and your purchase of products or services from The Third Facet. By visiting our website, submitting an order, or otherwise using our services, you agree to these Terms of Service.

If you do not agree to these terms, please do not use this website or purchase our products or services.

About The Third Facet

The Third Facet operates this online store and offers fine jewelry, custom-design services, consultations, educational content, and related products and services. Our online store is hosted by Shopify, which provides the ecommerce platform through which we offer products and services to you.

Eligibility and Acceptable Use

By using this website, you represent that you are at least the age of majority in your jurisdiction or that you have permission from a parent or legal guardian.

You may not use our website or services for unlawful, fraudulent, abusive, or unauthorized purposes. You may not interfere with the security, operation, or functionality of the website or attempt to gain unauthorized access to any system or information.

Product Information

We make reasonable efforts to describe and display our jewelry, diamonds, gemstones, precious metals, measurements, colors, and other product characteristics accurately.

Because jewelry is photographed under varying lighting conditions and viewed on different devices, colors and proportions may appear differently on screen. Images may be enlarged to show detail and may not represent actual scale.

Natural materials and handcrafted pieces may exhibit variations in color, pattern, dimensions, finish, stone characteristics, and appearance. These variations are not necessarily defects.

Diamond and Gemstone Information

Carat weights, dimensions, and other specifications may be approximate unless expressly stated otherwise. Total diamond or gemstone weight may vary slightly due to normal manufacturing and stone-matching tolerances.

Where a grading report or other independent documentation is included, the issuing laboratory or organization is responsible for the information in that document.

Availability

Products and services are subject to availability. We reserve the right to limit quantities, discontinue products, decline custom requests, or cancel an order when an item, material, stone, price, or service is unavailable or listed in error.

If we cancel an order after payment has been received, we will issue an appropriate refund for the canceled portion.

Pricing and Payment

Prices are displayed in United States dollars unless otherwise stated and are subject to change without notice.

Applicable taxes, shipping upgrades, design fees, sizing charges, and other costs will be displayed at checkout or communicated before you authorize them.

You agree to provide current, complete, and accurate billing, payment, shipping, and account information. You represent that you are authorized to use the payment method submitted with your order.

We reserve the right to correct pricing or product-information errors and to cancel or decline an affected order, including after an order has been submitted.

Orders

Submitting an order does not guarantee acceptance. We may accept, decline, limit, or cancel an order at our reasonable discretion, including when we suspect fraud, unauthorized activity, resale activity, pricing errors, inventory issues, or violations of these terms.

An order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance. Acceptance occurs when we confirm the order, begin production, or ship the product, as applicable.

Made-to-Order and Custom Jewelry

Made-to-order jewelry is produced after an order is placed and may require the production period stated on the product page or in your order communications.

Custom and bespoke jewelry may involve consultations, design concepts, stone sourcing, sketches, computer-aided design renderings, prototypes, approvals, deposits, and production milestones.

Deposits and payments for custom projects are generally non-refundable once design work, sourcing, or production has begun. Changes requested after approval may result in additional charges and revised timelines.

Renderings, drawings, waxes, models, and digital representations are design tools and may differ slightly from the finished handcrafted piece.

Shipping, Returns, and Warranty

Purchases are also governed by our Shipping Policy, Return and Refund Policy, and applicable warranty terms. Those policies are incorporated into these Terms of Service by reference.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Please notify us promptly if you suspect unauthorized access or use.

Third-Party Services and Links

Our website may contain links to or integrations with third-party websites, applications, payment processors, social platforms, or other services.

We do not control and are not responsible for third-party content, availability, security, privacy practices, products, or services. Your use of a third-party service is governed by that party's own terms and policies.

Reviews, Feedback, and Submissions

If you submit a review, testimonial, photograph, comment, suggestion, or other content, you represent that you have the right to provide it and that it does not violate the rights of another person.

You grant The Third Facet a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display content you voluntarily submit in connection with our business, marketing, and services, subject to applicable law and our Privacy Policy.

We may remove content that we reasonably consider unlawful, misleading, offensive, infringing, or otherwise inappropriate.

The website and its content—including The Third Facet name and branding, logos, jewelry designs, product names, photographs, videos, graphics, illustrations, written copy, layouts, and other creative materials—are owned by or licensed to The Third Facet and are protected by applicable intellectual-property laws.

No content may be copied, reproduced, modified, distributed, published, displayed, sold, reverse engineered, or used for commercial purposes without our prior written permission.

Nothing on this website grants a license or other right to use any trademark, trade name, service mark, design, copyright, or other intellectual property belonging to The Third Facet or another party.

Disclaimer of Warranties

Except for any express written warranty we provide and any warranties that cannot legally be excluded, the website, its content, and our services are provided on an “as is” and “as available” basis.

We do not warrant that the website will always be uninterrupted, secure, error-free, or free from harmful components.

To the fullest extent permitted by applicable law, The Third Facet and its owners, employees, agents, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to your use of the website, services, or products.

To the fullest extent permitted by law, our total liability arising from a particular purchase will not exceed the amount you paid to The Third Facet for the product or service giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Third Facet and its owners, employees, agents, contractors, affiliates, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your violation of these terms, misuse of the website or services, or infringement of another party's rights.

Privacy

Your submission and use of personal information are governed by our Privacy Policy.

Changes to These Terms

We may update these Terms of Service from time to time. The revised terms will be posted on this website with an updated effective date. Your continued use of the website after changes are posted constitutes acceptance of the revised terms to the extent permitted by law.

Severability

If any provision of these terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

No Waiver

Our failure to enforce any provision of these terms does not waive our right to enforce that provision or any other provision later.

Entire Agreement

These Terms of Service, together with the policies and notices referenced within them, constitute the entire agreement between you and The Third Facet concerning your use of the website and applicable purchases or services.

Governing Law

These terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.
